Savills were instructed by the London Borough of Hillingdon to act on two cases case involving the compulsory acquisition of land formerly used as a scrap yard and caravan park, for the creation of a public park used to mitigate the construction of the British Airways Headquarter building.
SOLUTION
Our objectives were to provide strategic advice and act as expert witness in the Upper Tribunal (Lands Chamber) reference, for both the Hall and Potter cases, with the landowners having made a substantially higher claim than the acquiring authority's valuation.
The Potter v Hillingdon case surrounded the argument over development and ransom value attributable to the underlying scheme, whilst the Hall v Hillingdon case surrounded the argument over the market value of the land and disturbance to the buisness.
RESULTS
Savills provided expert written evidence and appeared at the Upper Tribunal hearings for both cases.
The Potter v Hillingdon case resulted in receipt of an offer to settle the including costs and interest which was accepted by the client.
The Hall v Hillingdon case resulted in an award substantially closer to our opinion of value than the claimant’s
